As ISC INSAN KAYNAKLARI DANIŞMANLIK HİZMETLERİ LTD.ŞTİ. as the data controller, processes, stores, and transfers all personal data within our organization in accordance with the Personal Data Protection Law No. 6698 “KVKK,” emphasizing the importance of personal data security. Our company places great importance on the processing and protection of personal data belonging to Employee Candidates applying to the company in compliance with the Personal Data Protection Law No. 6698. The Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform, published in the Official Gazette dated 10.03.2018 and numbered 30356, defines its purpose in Article 1 as follows: “The purpose of this Communiqué is to determine the procedures and principles to be followed within the scope of the obligation to inform, which must be fulfilled by data controllers or persons authorized by them pursuant to Article 10 of the Personal Data Protection Law No. 6698.”

This clarification text has been prepared by our company, in its capacity as the data controller, to inform Employee Candidates whose personal data is collected, stored, and processed, in accordance with Article 10 of the Personal Data Protection Law, titled “Obligation of the Data Controller to Inform,” and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform.

  PURPOSES OF PROCESSING YOUR PERSONAL DATA

Your personal data, categorized in accordance with Article 4 of the Personal Data Protection Law, which includes General Principles such as compliance with the law and rules of honesty, accuracy and when necessary, being up to date, processing for specific, explicit, and legitimate purposes, being relevant, limited, and proportionate to the purposes for which they are processed, and being retained for the period stipulated in the relevant legislation or required for the purpose of processing, are processed for the following purposes:

Your identity information; (Name, surname, date of birth, ID card information, photograph) and Your contact information; (Residence address, work address, phone number, mobile phone number, email address, Skype and similar instant digital communication details) are processed for the purposes of Evaluating Job Applications, Management and Administration of Employment, Planning of Human Resources Processes, Execution of Employee Candidate / Intern Candidate / Student / Board Member / Committee Member Selection and Placement Processes, Management of Candidate Application Processes, Fulfillment of Contractual and Legal Obligations for Candidates, Ensuring Compliance with Legal Regulations, and Execution of Assignment Processes.

Your Employment and Professional Experience Data; Updated resume (CV), degree, experience information and certificate, certificate and diploma details, foreign language skills, education and competencies, courses attended, seminars attended, past titles, previous workplace information, references’ details / are processed for the purposes of Evaluating Job Applications, Management and Administration of Employment, Planning of Human Resources Processes, Execution of Employee Candidate / Intern Candidate / Student / Board Member / Committee Member Selection and Placement Processes, Management of Candidate Application Processes, Fulfillment of Contractual and Legal Obligations for Candidates.

KVKK Article 5/2-c: Processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract,

KVKK Article 5/2-e: Processing of data is necessary for the establishment, exercise, or protection of a right, on the basis of these legal grounds.

Your information obtained from references: This information is processed for the purposes of Planning Human Resources Processes, Execution of Employee and Intern Candidate Selection and Placement Processes and based on the legal grounds of KVKK Article 5/2-f: Processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

  TRANSFER OF YOUR PERSONAL DATA TO THİRD PARTİES AND ITS PURPOSE

The company acts in compliance with the regulations stipulated in Article 5, the provisions regarding the processing of Special Categories of Personal Data in Article 6, and the provisions regarding the transfer of personal data in Articles 8 and 9 of the Law, as well as the principles published by the Personal Data Protection Authority. Special category data is not processed or transferred without obtaining the explicit consent of the data subject.

* In order to conduct recruitment, selection, and evaluation processes and to carry out employment activities, your personal data may be transferred to our customers with whom we work, to the customers we serve or with whom we have agreements, to consultants providing services on behalf of our company, to independent audit firms within legal limitations, to technical support firms providing cloud-based application platform services, and, if deemed appropriate by our company, to third-party service providers. * In the scope of reference checks, your personal data may be transferred to the individuals you have provided as references. * In case of potential legal disputes between us, your personal data may be transferred to any judicial authorities, our lawyers, your authorized representatives, and your lawyers, within the legal conditions defined in Articles 5 and 6 of the Law and as required by other relevant laws..

These provisions also constitute the legal justifications for the data transfer.

  METHOD OF DATA COLLECTION AND LEGAL BASIS

The term “legal basis” in subparagraph (ç) of the first paragraph of Article 10 of the Law refers to which of the processing conditions specified in Articles 5 and 6 of the Law the personal data is processed under, within the scope of the obligation to inform.

Your personal data is collected through physical and digital means within the scope of the employment relationship, through the data you share with us as a private employment agency, the professional documents and information we request directly from you, the business partners we work with and who provide services to us, official institutions such as the Turkish Employment Agency (İŞKUR), publicly available records that you have made accessible to third parties, your references, information you send via email, petitions, applications, correspondence with our company, and requests made under Article 11 of the Personal Data Protection Law.

Your data is collected through electronic and physical means based on: Article 5/2-c of the Law: “Processing of personal data of the parties of a contract is necessary, provided that it is directly related to the establishment or performance of the contract,” Article 5/2-e: “Processing of data is necessary for the establishment, exercise, or protection of a right,” Article 5/2-f: “Processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.”

Additionally, special category personal data is collected with explicit consent. It is stored within the necessary conditions required by the job and for reasonable periods. Our company does not collect data without a valid purpose, legal basis, or explicit consent when required.

  YOUR RIGHTS

The company, in accordance with Article 10 of the Law, informs data subjects of their rights and guides them on how to exercise these rights. Pursuant to Article 11 of the Personal Data Protection Law, you may apply to our company to: Learn whether your personal data is processed, Request information if your personal data has been processed, Learn the purpose of processing your personal data and whether it is used in accordance with its purpose, Know the third parties to whom your personal data is transferred within the country or abroad, Request the correction of your personal data if it is incomplete or incorrect, Request the deletion or destruction of your personal data within the framework of Article 7 of the Law, provided that the company’s legal obligations are preserved, Request that third parties to whom your data has been transferred be informed of the actions taken under subparagraphs (d) and (e) above, Object to the occurrence of a result against you due to your personal data being analyzed exclusively by automated systems, Request compensation if you suffer damages due to the unlawful processing of your personal data.

To exercise your rights under Article 11 of the Law, you may submit a written application with a wet signature and deliver it in person to our address at: Üsküdar İçerenköy Yolu Cd. Bodur İş Merkezi No:8 Kat:8 Daire:31 İçerenköy Ataşehir-İSTANBUL or send it via a notary, or email it to iscinsankaynaklari@hs01.kep.tr (KEP) or info@iscconsulting.com using a secure electronic signature, mobile signature, or the email address you previously registered with our company.

Your requests will be processed free of charge within thirty (30) days at the latest, depending on the nature of the request. However, if the request incurs an additional cost to the company, the fee determined in the tariff set by the Personal Data Protection Authority’s Communiqué on the Procedures and Principles of Application to the Data Controller may be charged.
